Terms and Conditions
All videos submitted will become the property of Sponsor (Health 2.0 LLC) and will not be returned.
Selected submissions may be edited by Sponsor prior to posting.
Sponsor’s Rights: As the property of Sponsor, Sponsor has the unqualified right to use, reproduce, edit, market, store, distribute, have distributed, re-arrange, change, add to or delete from, translate, adapt or otherwise revise and/or alter the video and or blur or distort the content of the video depicted in the video, display, publicly and privately, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based on, and promote the video, for editorial, commercial, promotional and all other purposes.
Entrant’s Representations and Warranties: By uploading and submitting a video, you warrant and represent that the video: (a) is your own original work product and has been created lawfully; (b) does not infringe the intellectual property rights, privacy or publicity rights or any other legal or moral rights of any third party, or violate any applicable laws or regulations; (c) has not been submitted to any other contests, media entity, promotion, or program; and (d) has not been publicly exhibited, broadcast, published or distributed previously in any media or in any fashion. You further warrant and represent that you own all rights to the video, including, without limitation, all intellectual property rights to the video and all components thereof. You further warrant and represent that you have obtained permission from each person or entity whose name, image, likeness or voice (”Likeness”) is included in the video, and that each such person or entity has granted you all necessary rights to use their Likeness as described in these Rules and that you can make written copies of such grants of rights available to Sponsor upon request. If the Likeness of a minor is included in the video, such grant of rights must include written permission from the minor’s parent or legal guardian authorizing the use of the minor’s Likeness on behalf of the minor.
Releases: BY PARTICIPATING, EACH PERSON WHO SUBMITS A VIDEO (AN “ENTRANT”) ACCEPTS ALL RISKS AND CONSEQUENCES OF ENTRY AND PARTICIPATION AND AGREES TO FOREVER DISCHARGE, RELEASE AND HOLD HARMLESS SPONSOR AND ALL PROMOTION PARTIES FROM ANY AND ALL CONSEQUENCES, LIABILITY, LOSSES, DAMAGES (INCLUDING, WITHOUT LIMITATION, CONSEQUENTIAL, PUNITIVE, INCIDENTAL, SPECIAL OR ENHANCED DAMAGES AND THOSE RELATED TO PERSONAL INJURY, DEATH OR DAMAGE TO PROPERTY) AND COSTS AND EXPENSES, OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING FROM OR RELATED TO THE CONTEST, INCLUDING, WITHOUT LIMITATION, THE ENTRANT’S PARTICIPATION, HIS OR HER ENTRY OR ENTRIES, AND ANY CLAIMS BASED UPON U.S. OR FOREIGN INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY AND/OR INVASION OF PRIVACY, EVEN IF ONE OR MORE OF THE RELEASED PARTIES WERE AWARE OF THE POSSIBILITY OF ANY SUCH CONSEQUENCES, LOSSES, AND DAMAGES. EACH ENTRANT FURTHER AGREES TO FOREVER DISCHARGE, RELEASE AND HOLD HARMLESS ALL RELEASED PARTIES FROM ANY AND ALL CLAIMS THAT ANY USE OF A VIDEO BY OR ON BEHALF OF THE RELEASED PARTIES INFRINGES THE ENTRANT’S RIGHTS WITH REGARD TO ANY ELEMENTS, CHARACTERS, OR IDEAS CONTAINED IN ANY ENTRY.
